My claimant was involved in a severe head- on auto collision. He sustained multiple serious injuries including the need for back surgery. His wife filed a loss of consortium claim against the at fault driver. She received $90,000.00 and my claimant received $10,000.00. This is not something we can get credit or recovery from at the time of our settlement. During the entire recovery period he alleged he could not perform in the bedroom and was trying to get an authorized prescription for Viagra. Utilization Review denied authorization and we began to battle. He eventually had his low back surgery. Right after the surgery the Neuro called me personally and started the conversation with “The funniest thing popped up during surgery.” I did not initially catch on. So the Neuro went on to explain that after the claimant was put under anesthesia, before he even made the first cut, he got and maintained a very adequate erection. After receiving the doctor’s report the claimant immediately dropped his request for Viagra and the case was taken off calendar at the Workers’ Compensation Appeals Board. Hopefully, this will allow us to settle our permanent disability issues without a big battle as there is always the threat to turn him in for fraud against the auto carrier.
